Festi is a brand owned and operated by Suteka Inc. ("Company," "we," "us"). We know that when you share photos of your family—especially your children—you are trusting us with something precious. We take that responsibility seriously. This Privacy Policy describes how Suteka Inc. (d/b/a Festi) collects, uses, and protects your personal information.

1. Information We Collect

A. Information You Provide Directly

  • Order Information: When you make a purchase, we collect your name, billing address, shipping address, payment information (processed via Shopify), email address, and phone number.
  • Personalization Data: To create your party kit, we collect:
  • User Photos: These are the photos we use on the party decor items we print.
  • Names and Ages: The text details you provide for the products.
  • Event Details: Date and type of event (e.g., Birthday, Baby Shower).

B. Information Collected Automatically

  • Device and Usage Data: We use tools like Amplitude to collect data about how you access our Site (browser type, device type) and how you interact with our application (e.g., which themes you viewed).
  • Cookies: We use cookies to keep you logged in, remember your cart, and analyze site traffic (see our Cookie Policy for details). Our website also uses cookies to help keep track of items you put into your shopping cart, including when you have abandoned your cart.

2. How We Use Your Information

We use your information solely to provide and improve our service:

  1. Fulfillment: To process your payment, manufacture your personalized products, and ship them to your doorstep.
  2. Service Functionality: To operate the design editor and generate your personalized previews.
  3. Communication & Marketing: To send you order confirmations, shipping updates, and customer support responses (via Intercom). If you explicitly opt-in, we will also use your phone number to send you SMS marketing and transactional messages. We use Shopify, Amplitude, and website cookies to help keep track of items you put into your shopping cart, including when you have abandoned your cart. This information is used to determine when to send cart reminder messages via SMS.
  4. Improvement: We analyze usage data to understand which themes are popular and to improve our website's performance.

We do NOT sell your photos or personal data to third parties.

3. Photo Processing and Biometric Data

Festi uses advanced image processing technology to isolate faces from the photos you upload.

  • Storage: Your original photos and the processed ones are stored securely in our cloud infrastructure.
  • Retention: We retain these images for 3 years from your last order or interaction to allow for re-orders or customer support inquiries. After this period, data is archived or deleted in accordance with our retention schedule.
  • AI Usage: We may use AI algorithms to enhance image quality or generate avatars. This processing happens automatically and is used only to generate the designs you requested.

4. Sharing Your Information

We share your data only with the partners necessary to execute your order and manage our communications:

  • Suteka Inc. Affiliates: We may share data within the Suteka Inc. corporate family for operational purposes (e.g., if a support agent from the parent company handles your ticket).
  • Shopify: Powers our checkout and manages billing data.
  • Manufacturing Partners: Our US-based printing facilities receive the print files (containing your images and names) to physically produce the goods.
  • Logistics: Shipping providers (e.g., UPS) receive your address to deliver the package.
  • Customer Support: We use Intercom to manage chat and support emails.
  • Marketing Platforms: We use Klaviyo to manage and send our email and SMS marketing communications.

Important note regarding SMS data: The above excludes text messaging originator opt-in data and consent; this information will not be shared with any third parties.

5. Children's Privacy

Festi is a site for general audiences and is not directed at children under 13. However, our service allows parents and guardians to upload photos of children.

By uploading a photo of a child, you affirm that you are the parent or legal guardian of that child. We treat all photos of children with the highest level of security and do not use them for marketing or advertising without your explicit written consent.

6. Your Rights

Depending on your location, you may have the right to:

  • Access the personal information we hold about you.
  • Request the deletion of your personal information (including photos).
  • Opt-out of marketing emails.
  • Opt-out of SMS marketing at any time by replying "STOP" to any text message we send.
